Universal security trends in times of war and the necessary preservation of rights: World Constitution?

The situation of war between Russia and Ukraine summarizes the discussion on the need to find a means of preventing and punishing offenders, those who commit acts of barbarity with the spirit and repulsion expressed in the Preamble of the Universal Declaration of Human Rights of 1948. In 2002 the International Criminal Court began its activities only prosecuting natural persons for crimes such as: Crimes of genocide, crimes against humanity, war crimes and crimes of aggression. In twenty-one cases before the International Criminal Court, all were related to African States. This highlights the fragility of the solution in several aspects: From the effectiveness of the International Criminal Court's action, to the spectrum of its action to the scarcity of guarantees. This essay seeks to reflect on the construction of a World Constitution which confers rights, freedom and guarantees to be imposed on substantive and adjective criminal law.
