Abstract

We know that sexual violence is today one of the most serious forms of violence in existing societies, easily provoking in people an immediate feeling of aversion and repudiation. It covers a huge set of very violent sexual behaviors, which are described as Rape, sexual violations, sexual abuse, forced prostitution, trafficking for sexual exploitation, among others, according to the country. This conduct in Brazil is called Rape. In this context, the object of our article will be Rape of a vulnerable child under fourteen years old, whose typical description comes in an article of the Penal Code, where the sexual dignity of a child under fourteen is protected. Thus, in this essay, an approach was sought on the “consent of a person under fourteen years of age for the sexual act”; the differences between incest, pedophilia and sexual abuser; in addition to a perfunctory analysis of the “bilateral vulnerable rape” and the “Romeo and Juliet” law.
